1. Agreement to Terms
By downloading, accessing, or using the Step Up Or Pay Up mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and Step Up Or Pay Up ("Company", "we", "us", or "our").
2. App Description
Step Up Or Pay Up is a fitness accountability app that allows users to set daily fitness goals and attach consequences for failing to meet those goals. Consequences may include financial penalties charged to your payment method or social accountability through email notifications to your chosen contacts.
3. User Responsibilities
You agree to:
- Provide accurate and truthful information when setting up your account
- Maintain the security of your account credentials
- Use the App only for its intended purpose
- Comply with all applicable laws and regulations
- Not attempt to circumvent or manipulate the App's tracking mechanisms
- Accept responsibility for all activities under your account
4. Financial Terms and Penalties
Payment Authorization: By setting financial penalties, you authorize us to charge your connected payment method on every day you fail to meet your stated fitness goals.
Payment Processing: All payments are processed securely through our trusted payment processor, Paddle. We do not store your full payment details on our servers.
Email Penalties: If you choose to use email penalties, you authorize us to send an email to your chosen contacts on every day you fail to meet your stated fitness goals. Your own email address is included in the email.
Goal Modification: Goals and penalties cannot be modified once active for the current day. You may cancel future goals, which will take effect the following day.
5. Pricing and Fees
Free Usage with Goal Achievement: Step Up Or Pay Up is free to use, including all its features, as long as you successfully achieve your set goals each day.
Charges for Missed Goals: If you fail to meet a goal on a given day, you will be charged for the use of the app for that day. This charge serves as the penalty for not achieving your goal. By creating a goal with a financial penalty, you agree to these terms.
Penalty Amounts: When setting up a financial goal, you determine the penalty amount. This amount must be a minimum of $5.00 and a maximum of $500.00 per day for each goal that is not met.
Non-Financial Penalties: If you select a non-financial penalty, such as email notifications, the app remains completely free to use, regardless of whether you achieve your goals.
6. Refund Policy
14-Day Refund Window: You may request a refund for a financial penalty up to 14 days after the charge has taken place. To request a refund, please contact our support team at stepuporpayup@gmail.com with the details of your charge.
7. Health Data and Privacy
Data Usage: We access your health data (via Apple Health or Google Fit) solely for the purpose of tracking your progress toward your stated goals.
Data Security: Your health data is encrypted and protected using industry-standard security measures.
No Sharing: We do not sell, rent, or share your personal health data with third parties, except as required by law.
Medical Disclaimer: This app is not intended to provide medical advice. Consult with healthcare professionals before starting any fitness program.
8. Limitation of Liability
The App is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the App.
You acknowledge that fitness activities carry inherent risks, and you participate at your own risk. We are not responsible for any injuries or health issues that may arise from your use of the App.
9. Termination
You may terminate your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms.
Upon termination, you remain responsible for any outstanding financial penalties incurred before termination.
10. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or via email. Continued use of the App after changes constitutes acceptance of the new Terms.
